Please read these Terms and Conditions ("Terms") carefully before using the Food Recalls website, mobile applications, and related services (collectively, the "App" or "Services") made available by SmartAddress, Inc. ("SmartAddress," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
You may use the Services only if you are legally permitted to do so under applicable law. The Services are not directed to children under 13.
Food Recalls provides recall-related information and related features through a public website and mobile apps for recalls published by agencies in the United States, Canada, the United Kingdom, Ireland, the European Union, Australia, and New Zealand. The public website does not offer user account registration. Certain features, including paid subscriptions, may be offered only through the iOS and Android apps.
We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, to the extent permitted by law.
The public website does not currently allow users to create accounts. Our mobile apps currently support user accounts. If you create or use an account in a mobile app, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate information, keep it current, and notify us promptly of any unauthorized use or suspected security incident involving your account.
We may suspend, restrict, or terminate access to any account or feature if we believe you have violated these Terms, created risk for us or others, or used the Services in a fraudulent, abusive, or unlawful manner.
Paid subscriptions, if offered, are available only through our mobile apps and are purchased through the Apple App Store or Google Play, not through the public website.
If you purchase a subscription through Apple or Google:
Free trials, promotional pricing, introductory offers, and subscription prices may change from time to time to the extent permitted by law and the applicable platform rules.
If you download the iOS app from the Apple App Store or the Android app from Google Play, you also agree to comply with the applicable usage rules, terms, and policies of Apple or Google. Apple and Google are not responsible for providing maintenance or support for the Services except as required under their own terms or applicable law.

The Services may include content derived from third-party and government sources across multiple countries and regions, including the U.S. Food and Drug Administration (FDA), the U.S. Department of Agriculture (USDA/FSIS), the Canadian Food Inspection Agency (CFIA), the U.K. Food Standards Agency (FSA), the Food Safety Authority of Ireland (FSAI), the European Commission's Rapid Alert System for Food and Feed (RASFF), Food Standards Australia New Zealand (FSANZ), and New Zealand's Ministry for Primary Industries (MPI). That source content remains subject to the applicable source website terms, notices, and privacy policies.
We make reasonable efforts to present useful information, but we do not guarantee that any recall information, alert, search result, or third-party content is complete, current, accurate, or available at all times. The Services are for general informational purposes only and are not medical, legal, or professional advice.
The Services, including their design, text, graphics, logos, trademarks, software, and other content, are owned by SmartAddress or its licensors and are protected by applicable intellectual property laws. Except for the limited right to use the Services under these Terms, no right, title, or interest in the Services is transferred to you.
The Services may link to or rely on third-party services, including analytics providers, app stores, hosting providers, and external websites. We are not responsible for third-party services or content, and your use of them may be subject to separate terms and privacy policies.
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, posed a security risk, engaged in misuse, or where continued access could create liability for us or others.
You may stop using the Services at any time. If you have a mobile app subscription, deleting the app or stopping use does not automatically cancel your subscription. You must cancel through the Apple App Store or Google Play, as applicable.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTADDRESS, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SMARTADDRESS FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US, IF ANY, FOR THE APPLICABLE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain disclaimers or limitations of liability, so some of the above provisions may not apply to you.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SmartAddress and its affiliates, licensors, and service providers, and their respective officers, directors, employees, and agents, from and against claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees arising out of or relating to your violation of these Terms or misuse of the Services.
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles, except to the extent superseded by applicable law.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms and revise the last modified date below. By continuing to use the Services after the updated Terms become effective, you agree to the revised Terms.
